I’ve heard folks say “I own the domain name for my business, so I’m fine.” Or, “I just add the TM beside the name, and I’m good with that.” That would be a NO to both comments.
If someone starts a business with the same or similar name as your business and they get it federally Trademarked, they can legally have you cease and desist doing business under your business name. In addition, it’s against the law to use the TM symbol if you don’t have a federally registered Trademark.

What makes a trademark different from a patent or copyright? They’re all intellectual property, but here are the differences:
- A trademark protects a brand
- A patent protects an invention
- A Copyright protects original artistic and literary works (songs/movies/books)
For example: If you have an invention that you’re selling and using a song to promote the product, you’ll be applying for all three!
